Coming to Ohio? Lets hope

OHIOANS - Conservative Republican Ohio Senator Tim Grendell supports the Ohio Sovereignty Amendment and I have found that Sen. Grendell supports 99% of what I support 99% of the time. Registered voters might be asked to read a lengthy document for November ballot placement, then read it again to approve or disapprove the issue in the actual final Election Day decision.

That’s the Ohio Sovereignty Amendment.

The proposed Ohio Constitution change “expressly declares that Ohio citizens declare sovereignty over the state and their authority to alter or abolish government,” according to the amendment.

Among many issues, voters would be asked to:

* Give the people new power to recall any public officeholders by means of petition “whenever they deem necessary.”
* Mandate that recall vacancies be filled by the governor only with applicants nominated by citizens.
* “Substantially redefine the people’s right to bear arms (excluding explosives, biological and chemical systems).”
* “Secure the people’s right to operate their militia.”
* Require that all Ohio laws be “constitutionally compliant” before being enacted.
* Make the sheriff’s office “expressly preserved” in the Ohio Constitution and “not subject to infringement” by state legislators.
* Prohibit “federal or foreign agencies from enforcement activities in Ohio except through the sheriff at his sole discretion.”
* Give the Ohio Supreme Court new power to suspend “any law it deems to be unconstitutional.”
* Mandate that juries “may be comprised only of Ohio citizens.”
* Mandate that sovereignty “be supported in all schools in Ohio.”
* Declare that any attempts to “subvert the Constitution” are “not pardonable” by the governor if such acts are “deliberate or substantial subversive acts.”

In literature being distributed statewide, Michael Young, leader of the People’s Constitution Coalition of Ohio, wrote:

“The proposed amendment is not an attempt to secede from the union, to overthrow government or attack any race or culture. It simply provides the means by which the people can protect their rights and liberties with minimal government interference.

“(The proposed amendment) was constructed to hold government in compliance with and accountable to our state and federal constitutions. It provides the legal mechanisms that people need to ‘effectively and efficiently’ fulfill their duty in holding government accountable.

“There has not been a constitutionally compliant government in the United States for over 150 years. As a result, we find ourselves suffering today from a collapsing economy, perpetual debt, loss of our industrial base, surrendering of American sovereignty and destruction of our Christian heritage.”

Abolish the EPAs by Dave Macko

The federal Environmental Protection Agency was established by executive order by Nixon. Congress did not establish it.
It is not authorized by the Constitution and should be repealed.

According to http://en.wikipedia.org/wiki/Ohio_Environmental_Protection_Agency Ohio's EPA was created on October 23, 1972 just after the state income tax was imposed so that the government could squander more money. But I was unable to find out the date of founding at my quick inspection of the EPA's own site. Are they trying to hide something?

The EPA's site tells how they want to regulate every aspect of your life, including the air in your home.

If anyone pollutes air or water they should be charged with trespass and compelled to repair the damage which they have caused. We have courts for that purpose. For this reason the federal and state EPA's should be abolished.

We got along without EPA for almost 170 years. We can do so again.

TAX-oline

Hey Gang,
I have been juggling back and forth between the research of the socialist lead law and the oil spill. But right now I need to write about the latest taxes being proposed by the Democrats. One increase is for .18 cents, the other is .42 cents. Both are for gasoline. I don't even remember their names who spoke this nonsense, I was so upset when I heard it I almost threw my toaster at the TV.

The .18 cent hike would be for road improvements as people are driving less because of the recession and the high price of gas. The result of less driving is less tax revenue being generated for road maintenance. This lady said .18 cents is not that much less than a penny per mile since new cars average about 25 mpg.

OK think of how goofy these people are. There is less people driving because of high prices and as a result less tax revenue being generated for road repairs. The solution? Raise gas tax which raises gas prices which means people will drive even less and even less tax will be generated for road repair so you will need to raise gas tax again and..... Are you following this pattern?

The other tax hike of .42 cents would be for environmental clean up in cases of oil spills. It didn't take long for the tax-oholics to spot this opportunity.

So lets add this up. Currently in Ohio the gas tax is about .47 cents per gallon of gas, add .18 for road repair, .42 for clean up and you have a nice little figure of only $1.07 per gallon.

But remember the average new car gets 25 mpg. So lets figure you drive annually about 12,000 miles. 12,000 divided by 25, the mpg of the average new car, and you get 480 gallons of gas, times that by $1.07 and that equals out to only $513.60 annually just for your gas tax bill for your car.

C'mon thats nothing. VP Biden said its patriotic to pay your taxes. So think of it every time you fill up as your patriotic duty.

And our friend EGore, he must be loving this. If you remember he declared war on the internal combustion engine. Furthermore why should he care. He doesn't need to drive anywhere. Al's going to be nice and cozy staying home in the sprawling estate he bought on the west coast.

Here you go friends read it for yourself and WORRY! Welcome to communism.

This is the place, Glass Doctor, that I contacted to buy two more of the remaining windows I need at my rental. He wouldn't sell me the windows outright. So then I thought OK lets have them installed at a much greater cost and purchase them through Itex, a barter business association, that my cleaning business as well as the Glass Doctor belongs to. NOPE! Can't do that either.
Itex has really helped my cash situation as I have been bartering more and more. But now I can't even barter for windows???

Here's some figures for you on my one rental:
2003 bought the house, property tax about $965, now $1,663.86, rental fees $75.00 per year, trash fees just added $108 per year. Add that up, that is an additional $883.86 per year and now to upgrade the condition of the house is going to cost WAY MORE to remove windows that DON'T even have the original paint and that I could of done prior to April 20, 2010.

I am just sick to my stomach. Since 2005 when we elected the Democrats back into office its been an onslaught on our liberties.

Let me hear from you if you own a pre-1978 house. This is serious, don't hide your head in the sand, if it doesn't affect you now wait until you have to remodel or sell your house.

My friend Wayne is as incensed as we all are of the power of the EPA. No one is advocating pre-1970 standards but common sense needs to be applied. America is quickly becoming a Stalinist state while countries like China are growing and polluting far more than America is. EPA is suppose to protect the environment. What are they doing snooping around in people's houses trying to save us? Its not about our health, its about control.

Finally.... a Resolution/Bill proposed to cut the power of the EPA. ..be assured.... neither Casey nor Specter signed on to it. In the House version a few PA Reps had the cajones and a lot of Ohio Reps signed on. I do feel we will ...again... fold like a cheap suit and allow them to continue their unelected power position but this is showing even legislators are starting to question the powers of the EPA.


If jobs is what we need.... we need to rein in the EPA to a controlable level. There is a point where it goes too far. Then again, all who know me know of the "love" I have for the EPA, DEP and assorted uncontrolled money pits.

Finally someone understands

Ultimately, zoning, property taxes, lead laws and all such evil laws and regulations lead to one result, the abolition of private property in land, which the degenerate enemy of the human racewho founded the "modern" doctrine, Karl Marx, identified as Communism. 
  If I am elected I will work to abolish the Ohio Environmental Protection Agency.
 Our environment and, more importantly, our liberties, are best defended by the common law.
 As for the fedgov EPA, which Nixon established by executive order, not by an act of Congress which is supposed to make all federal laws, this agency and its edicts are certainly prime targetsfor nullification and interposition by the state legislature.

  I am continuing on about the EPA law concerning pre-1978 homes.  It is vital that I do.
   Its one thing to have liberties and freedoms taken away out side of home, you can always retreat to your house, after all a mans home is his castle - right?  But more and more property and homeowner rights have come under attack.  Once this basic right is gone where does a person go?  
  I have been pounding away at educating people of the Fourth Amendment for 2 years since Euclid came after me concerning the rental houses I own.  I warned you back then what next a residency permit to live in your own house?  Well wake up, it can't be that far off if we don't do something now to protect property rights.
  Read below what a friend sent me.  She emailed my rant about the replacement windows to her cousin who works for the EPA.  This is her cousins reply.  I will comment in a follow up email plus I have more info from Wayne and what he is trying to do do repeal the lead law.

I work for Ohio EPA, not U.S. EPA, but this is true for the most part.  You actually don't have to have a certified installer, but if you don't use one, it could hurt you later when you try to sell your home.  The issue isn't the window, it's the lead paint that was used until 1978.  Lead is a very hazardous substance and causes mental and neurological problems in chlidren.  Many children have been poisoned over the years from exposure to lead paint in older homes and apartments.
 
 
Frankly, I personally wouldn't do much renovation work on a home that might contain lead paint.  I offered to paint the out buildings on grandpa's farm last year.  The new people moving in want the buildings scraped and painted. I told mom I wouldn't go near scraping those buildings and they should hire a pro company because I'm sure there is lead-based exterior paint underneath the outer layer of paint.
 
If your friend is renting or selling a property, the federal real estate law already requires him to verify that it is free of lead paint, or disclose if the residence DOES contain lead paint. Here is information on that:http://www.hud.gov/offices/lead/enforcement/disclosure.cfm

Feel free to forward this to your friend. He should be able to buy the windows and install them himself, especially if he is going to live there. He would just be risking losing money on the sale if he ever tries to sell it.  I also think he would be risking a lawsuit if he doesn't take steps to make sure the property is either lead-free, or use a certified installer to do the work and take care of the lead paint in the process.  What if there is lead and he rents it to someone with kids and the kids get lead poisoning?  It's a big liability issue and, speaking peronally, for the cost of a few hundred dollars more, it would be worth having the peace of mind.
 
I'm sorry he thinks it's socialism - unless protecting children and society at large from hazardous material is socialism.  He's free to poison himself if he wants, but not someone else.  I'd think we are past the days of landlords being free to exploit renters in unsafe housing.

I agree with your appallment of the requirement to check for lead in homes built before 1978. What this needs is a conserted effort by contractors that have expressed their limiting them taking jobs on homes older than 1978. Soon, this legislation will also include industrial buildings as well. If the present industrial site has given employment for the last 50 years and wants to revamp and expand by redoing or rebuilding...this could pose a rethink of hiring or even doing this at all. What these people think is that this is good, yet they waited years for this to be put inplace.... How urgent was that?

Now back to the residential homes.... You and I both live in areas of the cities that were put together in the late 19th and early 20th century..... Key word is CENTURY!!! We are now expected to pay for the legal activities of those who came before us??? Another point.... I was raised and still live in a home that is 100 years old. There has to be lead somewhere....from interior to the paint on the outside. So...I am also a Baby Boomer.... we had the LARGEST percentage of people who innovated and invented, from scotch tape, velcro, superglue, to Space Travel and Computers. Does that sound like a generation of people who were conversely affected by Lead Paint?? I would match my High School Diploma of 1966 against any 2 year( and more ) degree from College that any Burger Slinger has today. What we are basing this all on is the Government allowing Slumlords to kennel up low income families in sub level living quarters. Kids who would actually eat the paint chips... ( I never recalled eating any but I am sure PIKA affected snot bubble kids and even some pregnant women have.)

As far as this is all concerned, I think the Government efforts are better served to stop the proliferation of Cadmium laced McDonalds glasses. Our homes have become liabilies to us when we want to fix or sell them. Thus this increases the cost to stay in them or less money at resale.... making our economy slide even faster into this Government directed abyss. We have given and accepted the fact that NON ELECTED ENTITIES can make policy and OMG... LAW!! EPA is the worst of the agencies as is DEP. Even WHO has been shown to have money involved in the Pharm Companies that made H1N1 innoculations while claiming falsely, of the PANDEMIC!!!! I saw this crap with the first Swine Flu Scare... in the 70s.

I also found out.... I think you may have gotten some bad info. You as the home owner, can buy those windows and install them by your own means. I have installed them and it takes about an hour on the high side. I am sure you can find some "guys" who can do the work as "friends" who you would give a certain amount of Monetary "Barter". I think this BS law only affects Contractors, not individuals.

I am checking here in PA for something similar and as of yet it seems to be State Generated. I could be wrong but there has to be an outcry to the politcians and the shakiness of a revote....

Since this I contacted my local legislators and it wasn't in lights here (Pa.) but it is part of the FED EPA and as of yet, no one is pushing. I expressed basically the things I gave you to them and one has responded that they will look into this. They were involved in killing the Feds stopping the tolling of I-80 so there is no reason they can't band together again.

Lets hope Wayne is right or you may find yourself in a battle as I was with Euclid fighting fines and jail time for protecting my property rights.

News from Euclid

Hey Gang,

An IM from a friend:
hey Carey I ran into former Euclid Mayor candidate Chris Litinowitcz. He needs money to fix a flat he is going to start pan handling innocent citizens for the cash. Which is highly illegal in Euclid.


Rich called and asked did you listen to the Mike Trivisonno Show? A caller was complaining about Euclid and their new trash fee. This caller said his house has been empty 2 years so he called Euclid City Hall and complained why should he pay the trash pick up fee when he doesn't put out any garbage? Euclid agreed so they reduced his fee by 50%.
Crazy days indeed.

I was at my friend Bruce's garage sale in Mentor on Saturday. I had the health care petition with me. I asked a man if he would sign it. He said NOPE, it doesn't matter, even if you get your amendment passed they (politicians) will still do what they want. Take Euclid, I use to live there. We voted against that housing development and they still went ahead with it.

At Dollar General the cashier, an older gentleman, was talking to a customer about how Euclid imposed a trash fee and ready for this he told her, a street light fee! I had to chime in and said I know, I keep saying it, white flight is only part of Euclid's problem. He said I agree, they have high taxes, low services, they are killing the city. I bought my parents house because I love the area but now I am stuck.
Hmmm another white man not bothered by blacks moving in. Just had to make sure you got the point.

What does Dave Macko have to say about housing inspections and regulations?

No city, county, township or other local jurisdiction shall prohibit the owner of any property from letting anyone he wishes live in such property. Any other position is communism, the abolition of private property in land.

Likewise, all property taxes should be repealed and outlawed. Zoning should be phased out, with restrictive covenants reestablished to prevent disorder.

Carey's humorous look at un-humorous events

Hey Gang,

The recent floods in Tennessee did a lot of damage. The only bright spot was that they happened in Nashville, the Capital of Country Music. So I am sure you can expect a flood, I mean a slew of new songs being released because of it.
Songs like "I was trolling for my Ford but snagged your John Deere" - "My dog was swept away but the cat fishing's been great" - "You left me high and dry just when the flood left me low and wet" - "I told you not to leave the bass boat was needed".

I think we are expecting to much from Obama concerning the oil in the gulf. I mean he can't even stop the flow of illegal aliens and now we expect him to stop the flow of oil.

What does BP stand for? BIG PROBLEMS!

Representative Kucinich has vowed his soul to Obama in exchange for another 550 million in bailout funds for Cleveland. Dennis wants to use the money to keep LeBron James in Cleveland.

People are still blaming Bush for everything. The other day I over heard someone say its Bush's fault the Cavs lost to the Celtics.

Al and Tipper Gore are getting a divorce. Tipper said Al was so concerned their steamy love making was contributing to global warming that he became very frigid.

Citibank has supposedly fired a female worker because her beauty was distracting. Maybe they were just jealous because her figure was a lot better than the figures of Citibank.

And that gets you updated.

A huge problem with this country is it’s need to certify and permit everything under the sun. Someone may point to the old snake oil salesmen etc and protection from scams but it is a huge problem that an agency that is not elected can actually have the force of law.
At the EPA site, they also have an official “rat someone out” hotline. Now tell me that doesn’t sound like Nazi Germany.

Think about this.... 1978 is 32 years ago.... Do you know how much time that is? They are chasing a dinosaur! I am sure a lot of these houses don't even have the original paint or windows but if they do they probably have been altered and/or modified over the years. If it was so dangerous get everyone out of their houses - NOW.

Seems like this is a rule by the EPA. The bigger question may be: how is an unelected body able to force contractors to comply? UNELECTED WOULD BE THE OPERATIVE WORD HERE. Read the final line at the EPA site

It passed in 2008, went into effect 2010, basically so you don't disturb lead-based paint. There might be a loophole if there is no one under 6 yrs of age living in the home, Im not sure. You can be certified after a 8 hr course.

EPA Requirements
Common renovation activities like sanding, cutting, and demolition can create hazardous lead dust and chips by disturbing lead-based paint, which can be harmful to adults and children.
To protect against this risk, on April 22, 2008, EPA issued a rule requiring the use of lead-safe practices and other actions aimed at preventing lead poisoning. Under the rule, beginning April 22, 2010, contractors performing renovation, repair and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978 must be certified and must follow specific work practices to prevent lead contamination.
EPA requires that firms performing renovation, repair, and painting projects that disturb lead-based paint in pre-1978 homes, child care facilities and schools be certified by EPA and that they use certified renovators who are trained by EPA-approved training providers to follow lead-safe work practices. Individuals can become certified renovators by taking an eight-hour training course from an EPA-approved training provider. OK think about this.... April 2008 was when this law was made and now it is being enforced. IF it was so crucial and dangerous why did they wait the 2 years? C'mon people wake up.

i dont read it that way. it says "CONTRACTORS" have to be certified. YOU aren't a contracter. you are a private individual.
if you still read it your way, that would mean everyone would have to hire a contracter to put a window in their own home. i've gone to lowes and 84 lumber,etc. here and bought windows without question. my electrician installed them. he is skilled at everything, but not certified.KRISTINE

The place I called here in Cleveland will not sell windows, I have to have them install the windows. YES as I said a place like Lowes and Home Depot you may be able to get away with it.
Your electrician can get away with it, read - get away with it also BUT IF the government finds out and wants to, he can be severly fined because he is a contractor that did not get the new certification.
Also the wording is tricky, if you live in your home you can still install them. Does this nonsense make sense? I live in my house so its less dangerous? THIS IS NOTHING BUT GOVERNMENT CONTROL OF THE HOUSING MARKET.
Furthermore, what about someone as myself, who has rental property. Am I in violation? I don't live there so does that mean I can't instal windows? Or paint?
Laws this broad, vague and intrusive is scary.
Another thing is cost. Windows will cost more to install because contractors need to be certified and that costs money for training AND if there is lead in the windows or frames will they be deemed hazardous? Will you need Hazmat to haul away your debris? Where will this end? Bad bill!

I would just install them anyway. No one has to know.

And what happens if the Feds want to inspect? Will I be fined and or jailed?

Unfortunately no John. No one that I spoke with was aware of this bill either. Why weren't we informed of this legislation? How does something THAT CONTROLS your house or property get put into law without our knowledge? It should be buyer beware. If a person is so fearful of lead let them buy elsewhere or have it inspected at their expense. I myself could care less.


Wait till Euclid gets their hands on this.
Just remember my plight with Euclid, it looks like the Feds will be doing the same but worse.

Be afraid very afraid of a bill like this! Home owner rights are going to be a thing of the past.
